Clearcaid Terms of Service

These Terms of Service govern your use of the websites located at https://www.viewalloptions.com/ and https://www.clearcaid.com/, the Clearcaid provider portal, Clearcaid Medicaid screening tools, lead capture tools, embedded forms and widgets, billing features, analytics dashboards, and related services provided by Clearcaid.

By accessing the website, creating an account, starting a trial, purchasing a subscription, embedding one of our tools, or otherwise using our services, you agree to these Terms of Service and to comply with all applicable laws and regulations. If you do not agree, you may not use the website or services.

We may update these Terms from time to time. When we do, we will update this page. Changes take effect when posted unless a later effective date is stated. Your continued use of the services after changes are posted means you accept the updated Terms.

Accounts and Organization Access

Some services require a provider or organization account. You are responsible for the accuracy of information submitted through your account, for maintaining the confidentiality of login credentials, and for all activity under your account. If you create or manage an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Organization owners and authorized administrators may invite team members, assign roles, manage access, configure branding, manage embeds and lead tools, view submitted leads or cases, and manage billing depending on their permissions. You are responsible for assigning appropriate permissions to your users and removing access when it is no longer needed.

Subscriptions, Trials, and Billing

Paid services may be offered through monthly subscriptions, trials, usage-based charges, or other plans shown at checkout or in the provider portal. By starting a paid subscription or free trial, you authorize Clearcaid and its payment processor to charge the payment method associated with your account for recurring subscription fees, applicable taxes, and any usage-based or overage charges described for your plan.

If a free trial is offered, the trial length and billing start date will be shown during signup or checkout. Unless you cancel before the trial ends, your subscription will begin automatically and your payment method will be charged on the billing start date. Subscription fees renew automatically until cancelled.

Some plans include a monthly allowance of Medicaid screens or other usage. If your plan includes an allowance and you exceed it, additional usage may be billed at the rate shown in the portal, checkout, or plan description. Usage allowances reset according to the applicable billing cycle unless otherwise stated.

You may manage payment methods, invoices, cancellations, and subscription changes through the billing portal when available. Downgrades, cancellations, and plan changes may take effect immediately or at the start of the next billing cycle depending on the plan and billing flow shown in the portal. Except where required by law or expressly stated in writing, fees already charged are non-refundable.

Medicaid Screener and Financial Eligibility Tools

Clearcaid and related Medicaid screening tools provide preliminary financial eligibility estimates based on information entered by users and the rules configured for supported states. The tools are informational only and are not a Medicaid eligibility determination, legal advice, financial advice, medical advice, or a substitute for review by a qualified professional or government agency.

You are responsible for reviewing all results before relying on them, sharing them, or using them in connection with a Medicaid application, admission decision, financial plan, or client consultation. Medicaid rules are complex and may change. Results may be incomplete or inaccurate if the information entered is incomplete, inaccurate, outdated, or not supported by the tool.

The services are designed to collect user-entered financial estimates and eligibility-related information, not medical diagnosis, treatment, clinical records, or other protected health information. Do not submit medical records, diagnoses, treatment notes, insurance claim records, or other clinical information through the services. Clearcaid is not acting as a HIPAA business associate unless we have entered into a separate written Business Associate Agreement with you.

Lead Capture, Embeds, and Third-Party Sites

Our services may allow you to create branded links, forms, embeds, widgets, landing pages, calculators, and lead capture tools for use on your own websites, advertising, outreach, or communications. You are responsible for where and how you deploy those tools, the content surrounding them, any notices or consents required for your users, and your compliance with laws that apply to your business.

Limitations of Use

By using the website or services, you warrant on behalf of yourself, your users, and any organization you represent that you will not:

Intellectual Property

The intellectual property in the website, services, software, designs, workflows, questions, calculators, reports, analytics, templates, text, graphics, and other materials made available by Clearcaid is owned by or licensed to Clearcaid and protected by applicable law. Subject to these Terms and any active subscription, we grant you a limited, non-exclusive, non-transferable license to use the services for your internal business purposes and authorized lead capture activities.

You retain ownership of your organization information, branding assets, and user-submitted content. You grant Clearcaid the rights necessary to host, process, display, transmit, and use that content to provide, secure, support, bill for, and improve the services.

Third-Party Services

The services may integrate with or rely on third-party providers for payment processing, hosting, analytics, maps, email delivery, spam prevention, customer relationship management, and other operational services. Your use of third-party services may be subject to their own terms and policies. We are not responsible for third-party services we do not control.

Liability

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, Clearcaid makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation,implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Clearcaid or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if Clearcaid or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, "consequential loss" includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

For purposes of this section, references to the website and materials include the provider portal, Clearcaid tools, lead capture tools, embedded forms and widgets, analytics, billing features, and related services.

Accuracy of Materials

The materials appearing on our website are not comprehensive and are for general information purposes only. Clearcaid does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.

Right to Terminate

We may suspend, limit, or terminate your right to use the website or services immediately upon written notice to you for any breach of these Terms of Service, payment failure, expired or cancelled subscription, misuse of the services, or activity that creates legal, security, privacy, or operational risk.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Massachusetts. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
